    Pala offencesnum capital punishment und, murder for instance. But there is no offence for which it is mandatory. Its either life imprisonment OR capital punishment. Courts are guided by the principle of "rarest of rare case" while awarding death sentence.Google rarest of rare case, or bachan Singh v state of Punjab.

    IMO, this was a case where the principle could have been applied. Pakshe athellam judgente view pole irikkum.
